Additional Wedding Package Agreement Terms

Payment or partial payment for services indicate an understanding by the client and/or payee that the verbal and written wedding package agreement shall become binding upon client, studio and their respective representatives 3 days after it's receipt. Any and all cancellations must be communicated in writing.

Client Agrees to pay a returned check fee of $30.00 or maximum allowed by law for each returned check.

Studio will not deliver to client proofs or any part of an order until the balance of the account has been paid in full.

Studio reserves the right to use the negatives, digital files and reproductions from them for any lawful purpose. Negatives, previews and all reproductions made there from remain property of the studio unless otherwise noted on contract. Client understands that no one may duplicate any photographs by the studio unless they have purchased the original digital files.

ALL PAYMENTS UNDER THIS AGREEMENT ARE CONSIDERED EARNED AND NON-REFUNDABLE

If the final album order is not returned to the studio within 6 month of the wedding date, then studio is not responsible to fulfill agreement.

Client agrees to return the final album order form within 60 days of receipt of previews. After 60 days client agrees to pay a late charge of ten percent of the total contract price on the reverse side.

STUDIO DISCLAIMS ALL WARRANTIES, BOTH EXPRESSED AND IMPLIED. STUDIO DISCLAIMS THAT PHOTOGRAPHS WILL BE FIT FOR A PARTICULAR PURPOSE OR MERCHANTABLE.

The studio and photographer agree to use their best efforts to cover the wedding ceremony and/or reception. If studio/photographer fails to fulfill their obligations under this agreement for any reason, then client, as sole remedy in the form of payment of liquidated damages, may receive whatever funds client has paid studio as full settlement of all claims against photographer/studio. Under no circumstances shall photographer/studio be liable for any consequential, direct or indirect or incidental damages.

Client may reorder photographs only within six months after the wedding.

All prices for albums and reproductions are subject to change without notice.

Client agrees to pay postage, touch up charges and any expenses not expressly covered by this agreement.

The parties agree that there are no third-party beneficiaries of this contract. This agreement exists solely for the benefit of client and studio.

Client agrees to pay for any additional time spent by the photographer at the rate of $100.00 per hour, unless “unlimited time” is specified under studio services on this agreement. The fee on the front only covers the services and estimated time described there. Any overtime charges incurred on the wedding date are due upon receipt of previews.

Studio reserves the right to use a different photographer from its staff in the event of an emergency.

If this agreement must be construed or enforced, then the prevailing party shall be entitled to receive from the other party the cost of collection, attorney’s fees (both before suit is filed and after post-judgment activities), with the venue in Sevier County, State of Tennessee with the laws of the state of Tennessee applied.

If the studio, in its sole discretion, agrees to change any date, then studio will require an additional fee for such a change. Studio cannot promise availability at any other time than the dates stated on the original agreement.
